Terms of Service

These Terms of Service apply to your use of the Footprints Property Inspections website and to any inspection services you request from Footprints Property Inspections, LLC ("Footprints," "we," "us," or "our"). Your specific inspection is also governed by the inspection agreement you sign before the inspection begins. If there is a conflict between these Terms and your signed inspection agreement, the signed agreement controls.

1. Acceptance of Terms

By visiting this website or using our services, you agree to these Terms of Service. If you do not agree, please do not use the site or request our services.

2. Services We Provide

Footprints provides residential, building, and commercial property inspections, along with related services such as radon testing, mold inspection, wood-destroying organism (WDO) inspection, HVAC evaluation, and pre-listing and warranty inspections. Service availability, scope, pricing, and turnaround times are subject to change without notice.

3. Nature and Scope of an Inspection

A property inspection is a limited, visual evaluation of the readily accessible systems and components of a property on the date of the inspection. It is not a guarantee, warranty, or insurance policy. It is not an engineering report, a code compliance review, or an exhaustive investigation of every condition that may exist.

Inspectors do not move furniture or stored items, dismantle equipment, open walls, test buried systems, or investigate conditions that are concealed, inaccessible, or not visible on the day of the inspection. Items outside the scope of the inspection are described in your inspection agreement and in the applicable standards of practice (such as the ASHI Standards of Practice).

4. Client Responsibilities

You agree to provide accurate information when requesting an inspection and to arrange timely access to the property. You also agree to review your inspection agreement before the inspection begins and to contact us with any questions about the scope of services.

5. Scheduling, Payment, and Cancellation

Payment is due no later than the time of inspection unless other arrangements are made in writing. We accept major credit cards (a 3% surcharge may apply to credit card payments), checks, and online payments through our payment provider. If you need to reschedule or cancel, please contact us as soon as possible. A fee may apply to last-minute cancellations.

6. Inspection Reports

Inspection reports are prepared for the exclusive use of the client named in the inspection agreement. Reports may not be relied upon by any other person without our written consent. Reports reflect the condition of the property on the date of the inspection only. We make no representation regarding future performance of any system, component, or condition.

7. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from or related to an inspection, a report, or our services is limited to the fee you paid for the service in question. Footprints is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, lost profits, or diminished property value. Nothing in these Terms limits your rights under the InterNACHI Buy Back Guarantee, which has its own separate terms and conditions.

8. No Warranty

An inspection is not a warranty or guarantee against defects. Except as expressly stated in your inspection agreement or in a separate written warranty, we make no warranties of any kind, express or implied, regarding the property, its systems, or its components.

9. Website Use

You agree not to misuse this website. That includes attempting to gain unauthorized access, interfering with site operations, scraping content, or using the site for any unlawful purpose. Information on the site is provided for general reference and is not a substitute for a signed inspection agreement or a completed inspection report.

10. Intellectual Property

All content on this website, including text, images, logos, photos, and graphics, is the property of Footprints Property Inspections, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. SMS and Text Messages

If you provide your mobile number, you consent to receive text messages from Footprints relating to your inspection, appointment reminders, payment confirmations, and occasional updates. Message and data rates may apply. You may opt out at any time by replying STOP. Your SMS consent is not required to use our services.

12. Age Requirement

You must be at least 18 years of age to request services, sign an inspection agreement, or enter into any other agreement with Footprints.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or our services will be resolved in the state or federal courts located in Summit County, Ohio, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the Effective Date at the top of this page. Your continued use of the site or our services after an update constitutes acceptance of the revised Terms.
